The Court found that a high-risk serious offender who conceded 13 contraventions of a supervision order (including possession of child exploitation material and multiple breaches of lawful directions) nonetheless satisfied the onus of demonstrating she would substantially comply with the standard conditions of an amended supervision order, such that a continuing detention order was not warranted. On the facts, protective factors including a stable intimate relationship, engagement with medical treatment, compliance with reporting obligations, and expert psychiatric opinion that the respondent could be adequately managed in the community supported this finding. The supervision order was amended to impose stricter conditions — including a prohibition on all images of children (whether indecent or not) and a prohibition on analogue recording devices — and extended by three years.
