The Court held that where a contemnor has purged contempt, accepted responsibility, and paid substantial indemnity costs ($103,496) that were nearly four times the assessed fine, the court's authority is sufficiently vindicated without imposing any additional penalty. The Court accepted that the gravamen of the contempt was the failure to engage with the process rather than the time taken to complete compliance, so the appropriate end date for a continuing fine was when the defendants began engaging (not when compliance was completed). The Court also confirmed that vague evidence of financial incapacity, while falling short of full and frank disclosure, may still be sufficient to support a finding that a contemnor lacks capacity to readily pay a fine.
