Compliance with s80(1) of the Work Health Act 1986 (NT) is a condition precedent to entitlement to compensation, not a procedural requirement that can be cured by s182. Section 182(2) does not empower the Work Health Court to excuse non-compliance with s80(1). The relevant reference point for measuring whether notice was given 'as soon as practicable' is not necessarily the date of injury but may be the date financial loss begins or the date the worker realised the injury was such that a claim might need to be made. Whether notice was given 'as soon as practicable' is a question of law where all material facts are found.
