The construction of a strategic plan forming part of a town planning scheme is a question of law, not fact, and expert town planning evidence on questions of construction is irrelevant. On appeal from the Planning and Environment Court for error of law, the appellant need not show the decision would have been different; it suffices that the error could have materially affected the decision. Strategic plan provisions protecting the primacy of an existing town centre should be construed distributively to maintain that centre's role across all identified functions.
