An HIV diagnosis without symptomatic progression to AIDS may justify a reduction in the non-parole period but does not warrant full suspension of a sentence for serious breach of trust offences. A non-parole period of one quarter of the head sentence (rather than the usual half) may adequately reflect the health condition as a mitigating factor.
