A sentencing judge may not take into account, for any purpose including denying leniency, evidence of uncharged criminal conduct that would establish a separate offence, a more serious offence, or a circumstance of aggravation. The previously accepted practice of using uncharged sexual offences to establish the 'real relationship' between offender and victim, or the offender's 'character', or to rebut a claim of 'isolated incident', is impermissible. A person convicted of a single offence is entitled to be sentenced as for a single offence.
