The Court of Appeal struck out the first appeal (against ANZ Banking Group) as incompetent, holding that the only right of appeal from a Magistrate's order striking out a statement of claim lay to the District Court under s 11A(b)(ii) of the Magistrates Court Act 1921. The second appeal, against a vexatious litigant declaration, was dismissed on the merits, with the Court agreeing entirely with the reasons of the judge below and holding that permitting the appellant to re-litigate matters already decided adversely to him on numerous occasions in the High Court, Federal Court and Court of Appeal would constitute an abuse of process.
