A sentencing judge's finding of remorse may be overturned on appeal where the offender's post-offence conduct — including continued offending, failures to appear, and general lawlessness — is inconsistent with genuine remorse. A 5-year driving disqualification may be inadequate where the offender was already subject to an absolute disqualification at the time of the offence, and the court may substitute an absolute disqualification under s 20(5) of the Traffic Act 1949 (Qld). Limited credit for a guilty plea is appropriate where there was no defence to the charge.
