The Court of Appeal allowed the Attorney-General's appeal against sentence, holding that a sentence of two years four months imprisonment for dangerous operation of a vehicle causing death was manifestly inadequate. The Court substituted a sentence of five years imprisonment, with eligibility for post-prison community-based release after three years. The Court confirmed that flight from the scene of a fatal accident is a significant aggravating factor, and that while making a sentence cumulative upon a prior unrelated sentence may warrant some reduction, it does not justify a substantial reduction from the sentence otherwise appropriate for the offending.
