A Domican identification direction must be given whenever a real question as to the reliability of identification emerges from the evidence, even where the complainant knew the accused well and even where defence counsel does not stress the identification issue. Where the prosecution tenders a record of interview, exculpatory statements therein are evidence of the truth of the facts stated and must not be characterised to the jury as not being evidence. In joint trials, an accomplice warning about a co-accused's evidence must be clearly confined to the case against the other accused.
