The mere fact that a co-accused's police interview contains statements prejudicial to the appellant does not require separate trials where the trial judge's summing-up clearly separates the evidence admissible against each accused. An appellate court should not lightly conclude that a jury would impermissibly use evidence admitted only against a co-accused.
