An arresting officer who participates in a common design to detain a person remains jointly responsible for false imprisonment throughout the detention, even during periods of physical absence from the detainee. Where a jury rejects an assault claim but finds false imprisonment, damages for psychological injury attributable to the assault cannot be recovered under the false imprisonment claim. Aggravated compensatory damages for false imprisonment may be sufficient to mark disapproval of police conduct without the need for a separate award of exemplary damages.
