Where a local council assumes responsibility for beach safety by opening a beach to swimmers and establishing a system to exclude surfboard riders, the absence of patrol officers from the beach at the time of an accident caused by a surfboard rider can constitute both breach of duty and a basis for inferring causation. The inference of causation from breach of a duty to prevent third-party harm (Betts v Whittingslowe) applies in the beach safety context.
