Part 12 rule 4C of the District Court Rules, which deems actions dismissed for failure to file a praecipe for trial by the prescribed date, is not inconsistent with the Limitation Act and is not ultra vires, because the rule does not extinguish the cause of action but permits revival in appropriate circumstances. A trial judge exercising discretion to refuse to extend time is entitled to take into account prejudice arising from late notification of additional allegations, even where that specific matter was not expressly argued by the opponent, provided it was raised at least indirectly in the evidence.
