Part 12 rule 4C of the District Court Rules, which deems dormant actions dismissed for failure to file a praecipe for trial, is valid. However, the general power to extend time under Pt 3 r2 and the dispensing power under Pt 1 r5 remain available to relieve against the consequences of deemed dismissal, even after the specific time limit in r4C(4) has expired. David Grant v Westpac is distinguishable because r4C(4) does not contain 'may only' language and there is no indication of a self-contained code.
