Where a worker travels in a direction away from home to visit a relative for a substantial period (here, two hours) before proceeding home, the travel constitutes two separate journeys rather than a single journey with a deviation, and the second leg is not protected by s 10 of the Workers Compensation Act 1987 (NSW). In journey claims under s 10(1A), an employer need not identify the precise cause of an unexplained motor vehicle accident to establish fault; the unexplained loss of control of a vehicle on a road is itself evidence of fault sufficient to raise an inference of negligence under res ipsa loquitur principles.
