There is no right of appeal to the Court of Appeal from a decision of the Trial Division granting or refusing leave to appeal from VCAT under s 148(1)(b) of the VCAT Act. The Trial Division's decision on leave is conclusive. This does not affect the right to appeal to the Court of Appeal from a substantive determination made by the Trial Division on appeal from VCAT after leave has been obtained.
