The 'exceptional circumstances' in s 31(5A) of the Sentencing Act 1991 must be truly exceptional and must have arisen since the suspended sentence was passed; compliance with an intensive correction order and psychiatric conditions pre-dating the suspended sentence may not meet this threshold. A sentencing judge's strong warning about the consequences of re-offending does not constitute disqualifying bias in subsequent breach proceedings.
