Sex offender reporting obligations under the Sex Offenders Registration Act 2004 (Vic) are generally irrelevant to sentencing unless they operate with unusual severity on a particular offender; however, the prohibition on child-related employment may be taken into account where the offender's career is thereby lost. The principle of equality requires that female offenders who commit sexual offences against male victims be sentenced consistently with how male offenders would be sentenced for equivalent offences against female victims. A manifestly inadequate wholly suspended sentence does not render the offender immune from immediate imprisonment on a successful Crown appeal.
