A sentencing judge who declines to find that an offender poses no risk of re-offending is not making an adverse finding requiring proof to the criminal standard; the judge is merely declining to treat specific deterrence as irrelevant. Offences under s 51 of the Crimes Act 1958 (Vic) involving breach of trust by a person in charge of vulnerable residents will ordinarily call for an immediate custodial sentence.
