In sentencing for sexual offences against children where consent is not a defence to the charge, the victim's active consent and provocative behaviour are nonetheless relevant mitigating factors and cannot be treated as 'entirely irrelevant'. Sentences at the lowest end of the range will be appropriate for consensual acts where the age difference is not great. General deterrence assumes considerable significance in cases involving the use of the Internet to procure sexual contact with children.
