An employer recovering a statutory indemnity under s 151Z(1)(d) of the Workers Compensation Act 1987 from a tortfeasor is entitled to interest under s 83A of the District Court Act 1973, even where the underlying claim arises from a motor vehicle accident and s 73 of the Motor Accidents Act 1988 would have precluded the worker from recovering interest on damages. Section 73 operates only at the stage of quantifying the indemnity and does not restrict the separate statutory entitlement to interest on the debt.
