An error of law by a victims compensation tribunal on a matter that is irrelevant to the determinative finding does not warrant remittal, even if the error is established. Clause 4 of Schedule 1 of the Victims Compensation Act regarding aggravation of pre-existing injuries only operates to reduce compensation once a compensable injury has been found; it does not bear on the threshold question of whether a compensable injury exists.
