Under the former shock provisions of the Victims Support and Rehabilitation Act 1996, compensation for shock is payable if either symptoms or disability (or both) persist for more than 6 weeks; both need not co-exist for the entire period. The word 'and' in cl 5(a) is to be read as a composite or portmanteau expression. The District Court's jurisdiction under s 39 extends to questions about the threshold requirements of cl 5(a) but not to determinations of whether an injury is specified in the schedule. A determination under the Act is a single composite determination that cannot be partially set aside under s 39(5)(b).
