A sentencing judge who proposes to make findings of fact inconsistent with the agreed statement of facts must warn the parties and give them an opportunity to address the departure by evidence or otherwise. Failure to do so constitutes error warranting appellate intervention. The obligation to give notice before departing from agreed facts is more compelling than the obligation to give notice before rejecting mitigation submissions.
