The Jurisic guideline starting points of two years (grievous bodily harm) and three years (death) for dangerous driving offences must be proportionately increased for the aggravated versions of those offences under s 52A(2) and (4) of the Crimes Act 1900 (NSW), which carry higher maximum penalties. A prior traffic record including a PCA conviction disqualifies an offender from any claim to leniency, and relative youth and good character are of limited value in dangerous driving cases given the importance of general deterrence.
