A trial judge may reconsider and revoke an order for separate trials made by a different judge where the material available has changed, applying the principles in R v Saunders and R v Wright. Evidence of acts and declarations of co-conspirators prior to an accused's entry into a joint criminal enterprise is admissible against the late joiner to show the nature of the enterprise, regardless of the accused's role or technical basis of liability. The Crown is not limited to presenting a minimalist case where it has admissible evidence to strengthen its contentions.
