Employees of a public benevolent institution who manage the institution's funds, investment portfolio and accounting records are performing work of a public benevolent nature for the purposes of s 9(a) of the Pay-roll Tax Act (NT), where those funds are used for the institution's benevolent purposes. However, employees providing commercial services to external entities for reward, where those services are not themselves benevolent activities of the institution, are not exclusively engaged in work of a public benevolent nature, even if the proceeds are used for benevolent purposes. The critical distinction is between work 'wholly ancillary to' the benevolent activities and work 'collateral' to them.
