A sentence of six years imprisonment (with parole after 18 months) for offences of threatening conduct with a knife where no actual physical harm was caused and the offender suffered from a mental disorder is manifestly excessive; three years with parole after one year is more consistent with current sentencing patterns. The constraints of s 92 of the Penalties and Sentences Act 1992 (Qld) mean that pre-sentence custody already served cannot be effectively circumvented when combining imprisonment with probation.
