A sentencing court has power under s 157(2) of the Penalties and Sentences Act 1992 to make a parole recommendation on a new sentence that would take effect prior to the parole eligibility date on the balance of an original term required to be served under s 187 of the Corrective Services Act 1988, even though the recommendation would only benefit the offender if the Community Corrections Board also grants relief under s 190(2). Where a suspended sentence is activated to run consecutively with a new sentence, a parole recommendation must not take effect before the commencement of the activated portion. Where an offender is subject to multiple suspended sentences, all should be dealt with at the same sentencing hearing.
