A person acquitted of a criminal charge may be prosecuted for perjury in respect of evidence given at the trial, and it is not necessary to prove that the false evidence secured or may have secured the acquittal; it suffices that the evidence was material to a question at issue. The prosecution will not constitute an abuse of process where the Crown evidence is substantially different from that at the original trial. The doctrines of res judicata, autrefois acquit, and issue estoppel do not prevent such a prosecution.
