Costs ought not to be awarded against a statutory tribunal whose suppression order is quashed on certiorari unless the tribunal has been guilty of serious misconduct, corruption, or has acted perversely. The fact that a tribunal did not follow the advice of counsel assisting is insufficient to ground a costs order. Where a tribunal confines its role in certiorari proceedings to what is permitted by Hardiman, it should not be exposed to costs liability.
