When fixing the length of a driving licence disqualification under s.28(1)(b) of the Road Safety Act 1986 (Vic), the sentencing court must consider: (1) the punitive element — the extent to which disqualification is required in the total punishment to mark community dissatisfaction, including aggravating/mitigating factors and the relationship to any custodial period; and (2) the offender's dependency on a licence, including rehabilitation prospects, employment needs, and medical treatment requirements. Failure to address these matters constitutes an error in the exercise of sentencing discretion. The proper construction of 'in connection with the driving of a motor vehicle' in s.28(1)(b) remains an open question.
