An appeal from a Review Officer's discretionary decision to a Compensation Magistrate's Court under s 84ZN(2) must identify a question of law; merely restating arguments or complaining about the result of a discretionary decision is insufficient. The duty to act fairly under s 84ZA(2) does not convert every perceived unfairness into an error of law. When considering disclosure of video surveillance material, decision-makers must consider fairness to both parties, including the prejudice to a worker from non-disclosure, and cannot determine the question by assuming the worker is untruthful.
