In sentencing for drug manufacturing offences, the potential of the manufacturing operation (based on available chemicals and equipment) is a relevant sentencing factor alongside the actual quantity produced, as it bears on the offender's overall culpability, premeditation, and the degree of danger to the community. This does not amount to sentencing for an uncommitted offence but is an evaluation of the offence against the whole of the surrounding circumstances. Personal circumstances and good antecedents play only a limited role in sentencing for drug manufacturing offences where deterrence and community protection are the principal considerations.
