An applicant for a stay of execution pending appeal must demonstrate both that enforcement would cause serious hardship and that the appeal has some prospects of success. Even where the consequences of enforcement (including bankruptcy) are serious, a stay will be refused if the appeal has no prospects of success. The risk of bankruptcy is not ordinarily a reason for granting a stay.
