The Full Court distilled six sequential principles governing applications for stay of execution pending appeal: (1) the successful litigant is ordinarily entitled to enforce the judgment; (2) the applicant bears the onus; (3) special circumstances must be shown; (4) the central issue is whether the appeal will be rendered nugatory without a stay; (5) even then, the appeal must have reasonable prospects of success; (6) the balance of convenience must favour the applicant. The Court also confirmed that the inherent jurisdiction supplements the Rules, and that O 47 r 13 informs but does not limit the Full Court's power.
