Where co-offenders act in concert in a drug importation offence and the evidence does not permit differentiation of their respective roles, the sentencing court is entitled to treat them as equally culpable. The defendant bears the burden of proving mitigating matters on the balance of probabilities, and in the absence of such proof, the court is not obliged to engage in favourable speculation about the defendant's lesser role.
