Where statutory remission applies under s 95 of the Sentencing Act 1995 (WA), the non-parole period should be appreciably less than two-thirds of the head sentence, and regard should be had to the real head sentence after statutory remission to ensure the benefit of parole is real. An offender whose objective conduct demonstrates active engagement in attempting to obtain possession of a commercial quantity of prohibited imports is to be sentenced prima facie as a principal; the burden of establishing a lesser role lies on the offender.
