An offender who co-operates with police internal affairs investigations into misconduct by investigating officers is entitled to a sentencing discount even where the co-operation is substantially self-motivated and used for forensic advantage at trial, though the discount will be less than in cases of genuine remorse or co-operation against co-offenders. Where the Crown declines to contest the value of co-operation, it is taken to accept defence submissions on the point. Sentencing judges must specify the discount given for co-operation.
