A land developer's holding of land in its 'land bank' for future subdivision constitutes 'actual use of the land' within s 59(f) of the Just Terms Act, entitling the developer to compensation for disturbance including legal costs and stamp duty incurred in purchasing replacement developable land. The causal connection between acquisition and purchase of replacement land is not destroyed by a delay of sixteen months or by the interim investment of compensation money at interest, provided the dispossessed owner is continuing the same business. The word 'actual' in s 59(f) distinguishes present use from future or potential use, but does not require physical use.
