Where an offender deliberately sets out to drive with a high-range blood alcohol concentration while tired, and then engages in a dangerous act (such as bending below the dashboard on a narrow bridge), the driving cannot be classified as 'momentary inattention or misjudgment' under the Jurisic guideline. Such conduct constitutes a deliberately and recklessly undertaken dangerous enterprise, and a non-custodial sentence will be manifestly inadequate. The starting point of two years full-time custody under Jurisic applies once the threshold of abandoning responsibility has been reached.
