Time spent in custody for unrelated offences (including where convictions are later quashed) cannot be credited against sentences for separate, later offences. Pre-sentence custody credit under the Crimes (Sentencing Procedure) Act, ss 24(a) and 47(3), applies only to custody referable to the offence for which sentence is being imposed. Karageorge, which allowed credit for time spent in custody pending trial on the same charges where a conviction was later quashed, is distinguishable from the situation where the custody relates to entirely different offences.
