The voluntary surrender of firearms to police constitutes assistance under s 23 of the Crimes (Sentencing Procedure) Act 1999 (NSW) that cannot properly be treated as nil, even where no information about the provenance of the weapons is provided; a discount of 5% was appropriate in such circumstances. The objective seriousness of drug manufacture and supply offences is not exacerbated by the possession of firearms; rather, the firearms offences are exacerbated by their connection to the drug enterprise. Pre-sentence custody that is solely referable to an unrelated charge cannot be credited against a sentence for other offences, even where the unrelated charge is subsequently withdrawn.
