Full-time custody remains the appropriate sentence for offences of perverting the course of justice under s 319 of the Crimes Act absent extraordinary circumstances, even where the offender was not the instigator and did not stand to benefit from the offence. The offender's role as a non-instigator and lack of personal benefit may affect the length of sentence but does not necessarily take the case below the custodial threshold. Genuine voluntary abandonment of the intention before the act is carried out may warrant a different sentencing approach.
