For offences of perverting the course of justice under s 319 of the Crimes Act 1900 (NSW), the appropriate sentence will normally involve a period of full time custody, although there may be exceptional cases where this is not required. Persistent attempts to procure false alibi evidence with financial inducements do not fall at the lower end of the range of s 319 offences. The fact that underlying charges were not proceeded with does not reduce culpability where the offender's conduct in procuring false evidence suggests a belief in the risk of conviction.
