Where a sentencing judge imposes Territory sentences that are to be served in addition to a reinstated federal sentence, the judge must expressly undertake the totality assessment to ensure the aggregate sentence is just and appropriate and not crushing. Taking breach of parole into account in fixing a non-parole period for subsequent offences does not constitute double punishment but rather affects the assessment of rehabilitation prospects, community protection, and personal deterrence.
