The Queensland Court of Appeal held that it was open to the jury to infer from the evidence that the fatal blows were inflicted by one or both appellants while acting in concert with a common intention of disabling the deceased, sustaining manslaughter convictions under Criminal Code s 7. The Court confirmed that where two persons act together in a joint assault and death results, both may be convicted as parties even where it cannot be determined which individual struck the fatal blow, provided the jury is satisfied of the common unlawful purpose.
