Under s 40C(c) of the Electrical Safety Act 2002 (Qld), the causation element requires proof of a causal relationship between the failure to ensure the business was conducted in an electrically safe way and the risk of death or serious injury to which an individual was exposed — not proof that the failure caused the actual injuries suffered. A duty holder with a concurrent electrical safety duty under s 27B cannot discharge that duty by relying on an electricity entity's obligations under s 208 of the Electrical Safety Regulation 2013 (Qld). A failure to take a measure that would have managed or mitigated a risk breaches the electrical safety duty even if the measure would not entirely eliminate the risk.
