The Queensland Court of Appeal allowed appeals against conviction for both appellants on certain counts: Walton's indecent assault conviction was set aside with an acquittal entered and his rape conviction was set aside with a retrial ordered; Harman's rape conviction was set aside with an acquittal entered but his indecent assault conviction was upheld and leave to appeal sentence refused. The Court addressed the proper application of s 7(1)(c) Criminal Code (joint enterprise) in the context of sexual offences, the adequacy of judicial directions on complainant intoxication and memory gaps, and the threshold for discharging jurors with connections to parties. McMurdo P dissented in part.
